Signed into law on December 18, 2019 and scheduled to take effect in significant part on June 15, 2020, New Jersey has again expanded the availability of expungements for individuals with past criminal convictions and arrests. Most noteworthy is the sweeping systemic changes made to how low-level marijuana convictions will be handled, the shortened waiting period before one is eligible for expungement in certain cases, and the so called “clean slate” expungements to be developed over the next year. Criminal law practitioners have seen changes over the past several years as criminal justice reform continues to be a focus of our State legislators, but this is the most dramatic change to date for individuals with a past criminal record.
